Terms of Service

These Terms govern your use of the NOCTI online store and purchases made through it. By using the store or placing an order, you agree to these Terms. Nothing in these Terms excludes rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Store use
You must use the store lawfully and provide accurate account, billing and delivery information. You must not interfere with the store, attempt unauthorised access, introduce malicious code, scrape the store in a way that disrupts service, or use our content for unlawful purposes.

Products and compatibility
We aim to describe and display products accurately. Screen settings, lighting and production variation can affect colour and appearance. Check the stated AirPods model compatibility before ordering. Availability, product details and collections may change without notice.

Prices and promotions
Prices are displayed in the currency shown by the store. Shipping, taxes and other charges are shown before purchase where applicable. Promotions are subject to their stated conditions and availability. For the Buy 4, Get 1 Free offer, five eligible items must be added to the cart; Shopify applies the discount to one eligible item, limited to one free item per order. Free Australian standard shipping currently applies from a A$75 merchandise subtotal.

Orders
Submitting an order is an offer to purchase. We may reject or cancel an order for legitimate reasons including suspected fraud, pricing or inventory errors, payment failure, legal restrictions or inability to fulfil. If we cancel an order after payment, we will refund the affected amount.

Payments
You authorise the selected payment provider to charge the final amount shown at checkout. Payment services may be governed by additional provider terms.

Shipping, returns and refunds
Our Shipping Policy and Returns and Refunds Policy form part of these Terms. Delivery dates are estimates unless expressly stated otherwise.

Intellectual property
The NOCTI name, store design, original text, graphics and other materials owned by us are protected by applicable intellectual property laws. Third-party names and marks remain the property of their respective owners. No licence is granted except the limited right to use the store for personal shopping.

Third-party services and links
The store may rely on Shopify, payment providers, carriers and other third parties. Third-party services are subject to their own terms and availability. We are not responsible for external websites we do not control.

Liability
To the maximum extent permitted by law, NOCTI is not liable for indirect or consequential loss arising from use of the store where that liability can lawfully be limited. Any limitation is subject to non-excludable consumer guarantees and other mandatory rights.

Changes
We may update these Terms by publishing a revised version. The version in force when an order is placed applies to that order unless a legal requirement says otherwise.

Governing law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
